A. Who can take out the insurance and how is the insurance taken out?
The insurance has to be taken out and paid before departure. It is not possible to take out this insurance after leaving Sweden.
However, you can extend previous insurance during your stay abroad. The travel insurance that you wish to extend or complete has to be taken out by Gouda Travel Insurance. The insurance is valid for you as a private person in capacity of traveller and is not valid for something that has a connection with your work or exercise of duty or other gainful employment.
B. Where is the insurance valid?

This policy can be taken out separately or as a supplement to the travel insurance that could be included in your householders´ comprehensive insurance. The insurance covers events that are described in the policy terms and conditions that occurs during the insurance period. If you due to illness, accident or other unforeseen events are unable to return to your place of domicile within the insurance period, the period of validity will be extended with as much time as is reasonably required for you to arrange a new insurance policy, but maximum of 10 days. The insurance premium for the extension is charged to you afterwards. The policy is only valid for the period specified in your insurance policy.
C.1.1 Complete insurance cover from day 1 of your journey
If a complete insurance cover by Gouda is taken out for the entire journey then the policy is effective from the moment you begin your journey up until the journey is completed. The journey begins when you leave your place of residence or equivalent and ends when you return to one of these places.
C.1.2 Supplement to the travel insurance in your householders´ comprehensive insurance
If the insurance is taken out in combination with the travel insurance in your householders´ comprehensive insurance there are special terms regarding coverage in the period when both insurances are in force, see “Supplement to the travel insurance in your householders´ comprehensive insurance” under each element. If this policy has been taken out for a longer insurance period than the period of coverage in your householders´ comprehensive insurance, Goudas insurance, from the expiry date of the householders´ comprehensive insurance, no longer constitutes a supplement, but a full travel insurance. The special terms regarding coverage in the supplementary period also expires at this time.
Example: You take out an insurance policy as supplement to the travel insurance in your householder comprehensive insurance for a journey that last for 100 days and your householders´ comprehensive insurance is valid for 45 days. The special terms regarding coverage in the supplementary period is then valid from day 1 until day 45 of your journey. On day 46 the special terms for the supplementary period then expires and Goudas travel insurance is then a full travel insurance for the remaining insurance period.
C.1.3 Insurance from day 46 of your journey
If insurance is taken out from day 46 of your journey then Goudas insurance is not valid at all for the first 45 days of your journey. From day 46 of your journey the insurance is valid as a full travel insurance. If the insurance is taken out to start when the period of coverage in your householders´ comprehensive insurance is no longer valid you have to take out this insurance from the day your householders comprehensive insurance is no longer valid.
C.2 Holiday guarantee
Holiday guarantee can only be taken out for journeys that are maximum 45 days of length.
If you take out insurance for a journey that lasts for longer than 45 days this element will automatically be excluded. If your journey is maximum 45 days of length you will have to exclude this element when you take out the insurance if you do not wish to have this element in your insurance cover. If you have excluded the holiday guarantee for a journey no longer than 45 days, this will show in your insurance policy.
C.3 Insurance period
The insurance period is the period for which you chose to take out the insurance, as shown on the insurance policy. Renewed insurance is effective the day after the previous period expires, provided you have renewed and paid the policy before the previous policy expires. The insurance covers the period you have chosen, but for a maximum of 12 months.
C.3.1 New insurance policy
The insurance is valid from and including your day of departure at the earliest, provided that payment has reached us before departure.
C.3.2 Extension
For an extension, the insurance is valid from the date of payment at the earliest. If you wish to extend your policy period during your stay abroad you must do this before your existing insurance expires, and the extension must be on the same or less extensive terms and conditions as the existing insurance. The insurance you wish to extend must have been taken out with Gouda.
C.3.3 Curtailment
If the policy holder interrupts his/her journey, the insurance expires 14 days after the policy holder returns to his/her place of residence. You are not regarded as travelling when you have been in Sweden for longer than a continuous period of 14 days.

The costs covered are dealt with in element E.1 to E.10 below.
E.1 Supplement to the travel insurance in your householders´ comprehensive insurance
If this insurance is taken out as a supplement to the travel insurance in your householders´ comprehensive insurance, the compensation during the supplementary period is the cost you have for excess to your householders´ comprehensive insurance, yet a maximum of SEK 2 000. The restrictions mentioned in elements E.2-E.10 are also valid for an insurance that is taken out as a supplement to the travel insurance in your householders´ comprehensive insurance. The claim must be handled according to the conditions in your householders´ comprehensive insurance before compensation can be approved due to these conditions.
E.2 Medical costs and hospital treatment
The policy holder will only be compensated for necessary and reasonable costs for acute medical treatment, hospital treatment and medicines and for treatment and means of assistance prescribed by the treating doctor to treat the illness or injury, provided this cannot wait until the policy holder returns to Sweden. The policy holder must visit a doctor at the place of stay without delay when becoming ill or injured. Treatment by a physiotherapist, naprapath or chiropractor abroad requires a referral from an authorised doctor. For illness, injuries or accidents requiring treatment lasting more than 60 days, Gouda reserve the right to decide whether treatment should continue in the country the policy holder is visiting or whether the policy holder should return to Sweden for further treatment. Should the policy holder, at the time of the accident, be ill or suffering other changes not normal for someone his/her age, the policy holder will only be compensated for the injury that would have occurred if the illness/changes had not existed at the time of the accident.
E.2.1 Health care in Sweden
For those who are given health care in Sweden and aren’t entitled to compensation from the Swedish public social insurance office are paid only the cost that would have been if the right had exist. The policy holder will only be compensated for health care and treatment costs in Sweden if the care or treatment is provided by public health service. Compensation will only be made up to the high cost protection level. For hospital care in Sweden the policy holder will receive payment for that part of the health fee that doesn’t correspond to the living costs the policy holder save while being hospitalized. The normal living cost is calculated to 1,5 pro mille of the base amount per day.
E.2.2 Restrictions
The policy holder will not receive payment for preventive health care, acupuncture, vaccinations, annual medical examinations, pregnancy tests, childbirth, cosmetic operations and eyesight tests at opticians. Check-ups and medication for previous illnesses and accidents are also not covered. See restrictions in element E.10.
E.2.3 Compensation period
The policy holder will be compensated for costs for acute illness and acute injury within a period of 60 days from his/her first visit to a doctor. If a new case of acute illness occurs in the same illness, the insured must have been free of symptom, treatment, and medicine during at least 30 days to be entitled to a new compensation period.
The compensation period for accidents is three years from the time of the accident. .
E.3 Dental treatment
E.3.1 Dental treatment due to accident
The policy holder will be compensated for dental treatment costs for injury caused by an accident. Damage to permanent dentures will be compensated in accordance with the same regulations that apply to natural teeth. This also applies to removable dentures that were in the mouth when damaged. The policy holder must visit a dentist at his/her place of stay immediately when damaging his/her teeth or dentures. With the exception of acute treatment, Gouda must approve both costs and treatment before treatments commences. Accident defines by a physical injury suffered involuntarily through a sudden external event (external force).
E.3.1.1 Limitations
The policy holder can only be compensated for treatment costs for injury that can be related to the accident. Estimated costs must be approved by Gouda before treatment commences. Dental damage caused by biting or chewing is not regarded as an accident and the policy holder will only receive compensation according to the regulation in element E.3.2 below.
The policy holder will not be compensated for dental treatment for accidents due to deficient oral hygiene or due to the policy holder not having regular dental treatment every 12 to 18 months.
If an accident is presumed to have been worsened due to deficient oral hygiene or due to not having regular dental treatment, the policy holder will just get compensation for the damage that can be assumed to have been the result if the policy holder had taken care of his/her teeth and had regular dental treatment every 12 to 18 months.
E.3.1.2 Compensation period
The policy holder will be compensated for dental treatment costs for a period of three years from the time of the accident.
E.3.2 Emergency dental treatment
The policy holder will be compensated for costs relating to temporary emergency dental treatment for acute dental problems. The policy holder is required to seek dental treatment at his/her place of stay without any delay after the conditions arise.
E.3.2.1 Limitations
The policy holder will not be compensated for normal and routine dental care and orthodontics. The policy holder will not be compensated for acute dental treatment that is due to deficient oral hygiene or due to the policy holder not having regular dental treatment. Dental treatment will only be compensated provided that the policy holder can prove that he/she has taken care of his/her teeth and had regular dental treatment every 12 to 18 months.
E.3.2.2 Compensation period
The policy holder will be compensated for a period of 60 days from the first visit to a dentist.
E.3.2.3 Maximum amount of compensation
The maximum amount of compensation for each individual case for acute dental problems is SEK 5 000.
E.4 Travel expenses for care and treatment
The policy holder will be compensated for necessary and reasonable local travelling expenses in connection with visits to doctor or nurse, for hospital treatment and physiotherapy. The policy holder will also be compensated for travelling expenses to and from dental treatment covered by this insurance.
Private made journeys with own car will be compensated on Swedish mileage basis. For health journeys in Sweden, the policy holder will be compensated in accordance to the Swedish public social insurance office criteria.
E.5 Additional expenses for repatriation
If the treating doctor at the place of stay concludes that the policy holder must interrupt the journey for medical reasons and return to Sweden, the policy holder will be compensated for additional expenses for repatriation. Both the necessity for the repatriation and the mode of the travel must be prescribed by the treating doctor and pre-authorized by Gouda Assistance. Compensation will also be approved for additional expenses for repatriation for one travelling companion with the same insurance, if this person otherwise is left alone at the destination. By repatriation Gouda means transportation of the ill or injured person to Sweden. The policy holder will be compensated provided that he/she returns to Sweden because of acute illness or acute injury within 60 days from the first visit to the doctor or within 3 years due to an accident.
E.6 Repatriation in case of death
In case that illness, injury or accident results in death, payment will be made to transport the deceased person to Sweden. Payment will be provided on condition that, in case of death through illness, the repatriation takes place within 60 days from the first visit to a doctor. Gouda Assistance must always be contacted when a deceased person is to be transported home. Instead of repatriation, Gouda can compensate costs for burial at the place of stay. Maximum amount is SEK 20 000.
E.7 Travel expenses for close relative to seriously ill, seriously injured or deceased person
If the treating doctor concludes that the policy holder’s condition due to illness, injury or accident is grave, or if in case of death, Gouda will compensate travel expenses with economy class from the homeland and back, including subsistence for up to two close relatives. The journey must be pre-authorized by Gouda or Gouda Assistance.
E.8 Changed accommodation
If the treating doctor at the place of stay certifies that the policy holder must change his/her accommodation or extend the stay due to acute illness, acute injury or accident, Gouda will compensate the policy holder for any additional costs for board and lodging for a maximum of 60 days from the first visit to a doctor. Gouda will compensate for additional costs for a home journey, if an admission to a hospital leads to the policy holder missing planned home journey
E.9 Travel expenses for the policy holder if a close relative becomes seriously ill, seriously injured or dies, or in case of substantial damage to your private residence in Sweden.
If the policy holder is forced to interrupt his/her stay abroad due to a close relative in Sweden becoming seriously ill, having a seriously accident or dying, or if the policy holders private residence or similar in Sweden is significantly damaged through a sudden and unforeseen event, the policy holder will be reimbursed for reasonable costs for the travel home to Sweden.
Compensation will also be approved for additional expenses for travelling home for one travelling companion with the same insurance, if this person otherwise is left alone at the destination. The policy holder will only be compensated for one journey home per illness/accident. To be entitled compensation the policy holder must provide a certificate from a doctor, police officer or other authority involved and immediately inform Gouda Assistance of the occurrence and receive our approval before commencing the travel home.
E.10 Exceptions and limitations
The policy does not cover medical expenses, travel costs or other costs due to health care needs that existed prior the journey. The insurance does, however, cover acute deterioration of an existing condition, but only for the additional costs occurred as a result of the deterioration. Those who are receiving care in Sweden but do not qualify for a Swedish public social insurance will only be compensated for the cost that would have been if they had qualified for a Swedish public social insurance.
The following situations/cases are not covered by the insurance:
• Accident, illness or injury caused by the use of doping substances, alcohol, narcotic or similar substances.
• Costs connected to suicide or suicide attempts.
• Costs connected to check-ups due to pregnancy or childbirth. Notification: The insurance does however cover for necessary and reasonable costs for care during pregnancy until the 32nd week of pregnancy if complications arise within the insurance period.
• The insurance will not cover the newborn child in the event of childbirth.
• Costs connected to abortion, sterilisation, fertility treatment and fertility examinations.
• Costs due to boats or planes having to change course due to policy holders´ injury.
• Costs for staying at a spa-, health- or rehabilitation centre and/or travelling expenses incurred thereof.
• Costs for private health care in Sweden.
• Additional costs for journeys to and from studies/work as a result of your illness, injury or accident.
• Costs paid from other sources in compliance with law, statutes, conventions or other insurance policies.
• Costs for illness, injury or accident as a result of an atomic nuclear process connected with military operations in which the policy holder is involved.
• Costs connected with occupational manual labor.
• Costs due to an existing medical condition which has shown symptoms within 6 months prior the insurance policy applies
• Costs for repatriation or other transportation prompted solely by your fear or anxiety of infection or other risk.
• Costs that could have been avoided due to utilization of the European health insurance card held bye the Swedish public social insurance office.
• Costs related to the exceptions listed in group 3 in element G.2 mentioned below.
• Costs for treatment in the country of residence if the policy holder chooses to stay in the country even if the insurance has expired and no extension is subscribed and paid, even if the compensation period (60 days respective 3 years) still runs.
• Additional costs incurred as a result of the policy holder travelling to Sweden and/or back to the country of residence without Gouda’s approval.
• Additional costs incurred as a result of a close relative travelling to the policy holder’s country of residence without Gouda’s approval.
F. Compensation for disability and death due to an accident.
F.1 Insurance amounts
• For total, 100 %, medical disability the amount paid is SEK 300 000
• For total, 100 %, economic disability the amount paid is SEK 300 000
• For death the amount paid is SEK 25 000
• The maximum amount paid for means of assistance is SEK 25 000
F.2 What qualifies as an accident?
Accident shall be deemed to mean physical injuries suffered as a result of sudden external force (external violence). For frostbites, heatstroke and sunstroke the requirement for “sudden” is disregarded. The day the injury first appears will be considered as the time of the accident.
F.2.1 Exceptions:
The following events are not considered as accidents:
• A great exertion that causes for example muscle rupture or lumbago. This cannot be considered as an accident since it lacks the external force that characterizes an accident.
• Injury caused by the use of a doping or narcotic substance.
• Injury caused by infection by bacteria, a virus or other infectious matter.
• Injury caused by the use of medical substances or through operation, treatment or examination not caused by an accident covered by this insurance.
• Such a condition – even if diagnosed after an accident – that, according to medical experience, cannot be attributable to the accident but to illness, disablement or unhealthy changes.
F.3 Disability
In case of disability, Gouda will pay compensation in accordance with the degree of disability. When determining the degree of disability, an assessment is made based on the financial disability if such exist, followed by the medical disability. The assessment must however always be based on the disability that gives the highest compensation. Payment can never be made for both medical and financial disability.
F.3.1 Medical disability
Medical disability means future permanent reduction of bodily functions resulting from the accident. Medical disability also includes disfiguring scars, permanent aches and pains and loss of senses and/or internal organs.
The policy holder is entitled compensation for disability if the injury caused by the accident causes disability within three years of the accident, and at least twelve months have passed since the accident. When the definite degree of disability has been established, payment will be made with an amount of the full value of the policy that corresponds to the degree of disability. Please note the restrictions stated in element G.1-G.3.
If the degree of disability can be established within twelve months from the accident, the right to compensation shall apply and compensation will be paid once the degree of disability has been established. The definite degree of disability should, if possible, be determined within three years of the accident. It can, however, be postponed if, according to medical expertise, this is necessary.
F.3.1.1 Assessment of medical disability
Assessment is made irrespective of how much the capacity for work has been reduced due to the accident. Physical injuries caused by the accident and which can objectively be verified will form the basis assessing the degree of disability. The medical degree of disability is determined in accordance with a table drawn up by the Swedish insurance line of business. If the accident causes multiple injuries, compensation will be based on one degree of disability and will not exceed the full amount. If the functioning level of the injured body part was already reduced before the accident, the precious medical degree of disability will be deducted.
F.3.2 Financial disability
Financial disability means a future permanent reduction in the policy holders working capacity of at least 50 % as a result of the accident. The policy holder is entitled to financial disability when the accident causes a permanent reduction in his/her working capacity of at least 50 % and the Swedish public social insurance office grants early retirement of at least 50 %. The policy holder, however, is not entitled to claim until at earliest the day his/her early retirement pension is paid. The policy holder’s working capacity is considered as being reduces when all possibilities for work in other occupations have been explored and the Swedish public social insurance office has approved early retirement in accordance with the Swedish national insurance act.
In addition, before the financial disability comes into force and within three years from the date of the injury, you shall have been compensated for medical disability.
If the policy holder, at the time of the accident, is receiving partial sickness benefit or partial early retirement pension, he/she can only claim financial disability up to a maximum amount that corresponds to the loss of his/her remaining working capacity. If the policy holder, at the time of the accident, is receiving full benefit or full early retirement pension, he/she is not entitled to financial disability.
F.3.3 Compensation in case of death
Compensation in case of death is payable provided the accident leads to death within three years from the date of accident. Please note the restrictions stated in element G.1-G.3. Compensation in case of death is paid to the estate of the deceased. Should death occur prior to the commencement of disability allowance the disability allowance will not be paid. Should death occur after the commencement of disability allowance but before the final payment is made, payment will be made do the deceased persons estate to the amount that corresponds to the medical disability secured before death occurred.
F.4 Means of assistance for disability
As well as disability compensation the policy holder can also claim compensation for means of assistance and other medical measures prescribed by a doctor as necessary in order to relieve the discomfort caused by his/her disability and for which the policy holder is not receiving compensation from elsewhere in accordance with legislation or special statutes. The amount payable will not exceed a total of SEK 25 000 and only covers expenses approved by Gouda in advance.
F.5 Re-examination
Should the injury caused by the accident cause significant worsening of bodily functions or working capacity after the final settlement has been reached, the policy holder is entitled to have his/her degree of disability examined again. Re-examination cannot, however, take place when 10 years have gone from the time of the accident.
G. Limitations
These limitations are applicable to all parts of the insurance.
G.1 Flying
The following applies to people who are undergoing pilot training. This insurance covers flying accidents during training when the policy holder is the pilot or is performing another function on board and the policy holder is flying together with a qualified instructor in possession of a valid pilot’s certificate.
G.2 Sport activities
Below follows a list of the sporting activities fully covered by the insurance, those with reduced cover and those that are not covered by this insurance.

Mounting climbing expeditions/climbing without ropes
Deep sea diving
Single-handed sailing/extreme forms of sailing (e.g. sailing over the Atlantic ocean)
Ice climbing
Motor sports
Off-piste skiing (without a guide)
Competitive sports (speed and record-breaking activities etc.)
Other dangerous sports
PLEASE NOTE! These are examples of activities. Activities similar to these examples are also classified as group 3 activities.
G.3 Atomic nuclear process
The insurance does not cover accidents caused by an atomic nuclear process if the process is connected with military activities in which the policy holder is involved.
H. Liability
H.1 Supplement to the travel insurance in your householders’ comprehensive insurance
If this insurance is taken out as a supplement to the travel insurance in your householders’ comprehensive insurance, the compensation during the supplement period is the cost for excess to the householders´ comprehensive insurance, but the maximum amount payable is SEK 10 000 for each individual claim for damages. This also applies if several injuries or causes occur at the same time for the same reason. Before being entitled to reimbursement as stated above, the injury or damage must be settled in accordance with the terms and conditions of the householders’ comprehensive insurance.
H.2 How Gouda deal with claims for damages
If claims are made against the policy holder:
• Gouda investigate whether the policy holder is liable to pay damages
• Gouda negotiate with those claiming damages
• Gouda will speak on the policy holders’ behalf in court and also pay the costs of the court proceedings if these cannot be obtained from the counter part
• Gouda will pay any damages that the policy holder is liable for in compliance with current laws relating to claims for damages
H.3 Maximum compensation
The maximum compensation for each individual case of damages is SEK 2 000 000. This also applies if several injuries or cases of damage occur at the same time for the same reason.
H.4 Damage to rented premises
The insurance covers damage caused by the policy holder to hotel rooms or other rented premises and fixtures and fittings thereof.
H.4.1 Exceptions
Damage due to wear and tear or neglect is never paid and neither is damage caused by gross negligence or wilful actions.
H.5 What the insurance does not cover
H.5.1 Limitation
The insurance does not cover over and above current Swedish Law on Damages.
H.5.2 Exceptions
The insurance does not cover
• damage to property the policy holder has rented, borrowed, modified, repaired or in any other way occupied on more than a temporary basis(for rented premises, see H.4)
• damage the policy holder could be liable for as owner of a property, as possessor of a ground lease or owner of an apartment abroad
• damage arising from wilful actions which, according to Swedish law could lead to imprisonment
• damage the policy holder could be liable for as owner, user or driver of:
a) A motor vehicle where damage is caused when using the vehicle in traffic.
b) All forms of crafts made for travelling on or under water
Note: The policy covers injury if the boat is equipped with a maximum 6 hp outboard engine or a sail area of maximum 7.5 square meters. This also applies to a wind surfing board regardless of sail area.
c) All forms of crafts made for air travel
H.6 If damage claims are made against you
If damages are claimed against the policy holder and he/she accepts liability, approves the amount of damage or pay the damages without Goudas consent, then this will not be binding on Gouda. If the policy holder has to go to court the policy holder must immediately inform Gouda and follow our instructions, otherwise the verdict will not be binding on Gouda.
H.7 Policy holder responsibility
A written claim, directed against the policy holder by the affected party, shall be handled in to Gouda.
I. Legal protection
If this insurance is taken out as a supplement to the travel insurance in your householders’ comprehensive insurance the insurance covers according to I.1 The legal protection covers the policy holder as a private individual in his/her capacity as traveller and not in relation to occupation, exercise of duties or other gainful employment.
I.1 Supplement to the travel insurance in your householders’ comprehensive insurance
If this insurance is taken out as a supplement to the travel insurance in your householders’ comprehensive insurance the compensation during the supplement period is the cost for excess to the householders’ comprehensive insurance, but the maximum amount payable is SEK 10 000 for each individual claim. This also applies if several injuries or cases of damage occur at the same time for the same reason. Before being entitled to reimbursement as stated above, the injury or damage must be settled in accordance with the terms and conditions of the householders’ comprehensive insurance.
I.2 Disputes covered by the insurance
The insurance covers disputes that can be settled by a District court or dispute that after trial in a district court can be tried by the court of Appeal or the Supreme Court, or a corresponding court/authority abroad.
I.2.1 Note
The insurance does not cover criminal action or disputes that can only be tried by Administrative Authorities or Special Courts such as Property Registration Authorities, Social Insurance Court, Rent Tribunals, Administrative Courts of Appeal, Country Administrative Boards, Country Administrative Courts, Country Tax Courts or the Supreme Administrative Court or a corresponding authority abroad.
I.3 The insurance does not cover:
Disputes
• regarding divorce proceeding or other issues surrounding divorce such as custody, maintenance, diversion of joint property and ownership rights or corresponding issues surrounding separation
• that in a trial should be handled in accordance to The Swedish Code of Judicial Procedure Chapter 1, Section 3d, 1st paragraph (small claims). This exception should not be applied on disputes due to this policy.
• regarding occupational or official duties or other forms of gainful activity.
• connected to a guarantee obligation of the policy holder for the benefit of other persons in their gainful employment
• which concern financial measures which are of unusual character or extent for a private person
• concerning claims or demands transferred to the policy holder
• that concern the policy holder as owner, occupier, purchaser or seller of an apartment, house, tenancy rights, property, real estate or site-leasehold.
• that concern the policy holder as owner, user, or driver of a motor vehicle, caravan or other trailer, aircraft, ship, steam, motor or sailing boat with the exception of a rowing boat.
• which concern damages or other claims against the policy holder due to actions that gives rise to suspicion of, or prosecution for or crimes of a punishable character.
• where the policy holder has no justifiable interest in being processed. Such an interest shall not, for example, be deemed to exist if a court or legal aid authority rejects an application for legal aid or decides that legal aid should cease.
I.4 Legal representation
In order for the insurance to be valid, the policy holder must be legally represented in a dispute. The representative must be pre-approved by Gouda.
I.4.1 Requirements
The legal representative must be suitable with regards to the policy holders’ place of residence and the nature of the dispute and:
• be a lawyer employed by a lawyers office
• be able to verify that he/she at some point during the past three years has been assigned council for a case in accordance with the legal aid act in disputes of a similar character and are still suitable for such council.
• in a satisfactory way show he/she is particularly suitable for the assignment. The suitability of the legal representative is investigated by the Swedish Insurance Companies’ Legal Protection Board.
I.4.2 Examination of fees
A legal representative whose suitability has been examined by the Swedish Insurance Companies’ Legal Protection Board must undertake to accept the Board’s decision regarding fees and expenses for the case. If the legal representative is a lawyer, Gouda is entitled to demand arbitration at the Swedish Bar Association concerning the reasonableness of fees and expenses.
I.5 Costs covered by the Insurance
In the first assistance, the policy holder should engage legal aid, as Gouda will not pay costs which may or may have been paid by public funds if an application had been made. The policy holder can receive compensation for the following costs if they are necessary and reasonable and if the policy holder cannot recover them from the counter party or of the State. This means that Gouda will not repay costs if the policy holder, in or out of court, waives his/her rights to receive compensation from counter party. If damages to the policy holder may be considered also to include compensation for his/her advocates’ expenses, no benefit will be paid for such costs under this insurance.
• Fees and expenses for legal representation are paid for a reasonable period of time and in accordance with the hourly expenses applied by the Swedish National Courts Administration. The number of hours spent on the dispute and fee shall be pre-approved by Gouda.
• Costs of investigation prior to a court case will be paid, provided that the investigation is ordered by the legal representative or that National Board for Consumer Complaints has found it clear that the Board cannot settle the dispute without such an investigation.
• Costs will be paid in order to prove the policy holders case in court, or costs of arbitration proceedings.
• Court administrative costs will be paid.
• Costs will be paid for legal proceedings in court that the policy holder have been ordered to pay to the other party or the state after the dispute has been dealt with in the court or via arbitration.
• Costs will be paid for legal proceedings in court which the policy holder, in a settlement in the course of hearing, have undertaken to pay to the other party, provided that it is clear that the court would have ordered the policy holder to pay a higher amount in costs for the case if the dispute hade been concluded in court.
I.6 Costs not covered by the policy
• Own work, loss of income, travel expenses, board and lodgings or other out-of-pocket expenses for the policy holder him-/herself or other policy holder.
• The execution of a verdict, decision or agreement.
• Additional costs which arise if the policy holder engage several representatives, or changes representatives.
• Remuneration to arbitrators.
• The supplementary charge payable under Section 14 of the Legal Aid Act. • Costs not reimbursed by the government on grounds that the question of legal aid may be deferred while another similar is heard under Section 8 of the Legal Aid Act, or if it may be assumed that a similar judgement would have been made if the policy holder in other aspects had been entitled to legal aid.
• Costs of representation that is not reimbursed via legal aid because the policy holder has changed his/her representative or chosen a representative who, in view of circumstances, is not considered suitable.
• Gouda will not pay compensation if the damage can be compensated through another insurance policy.
I.7 Maximum amount
• For each dispute Gouda pay necessary and reasonable costs, but maximum compensation is SEK 100 000.
• If the policy holder and another insured person are on the same side in a dispute, this will be considered as one dispute and the maximum compensation will therefore be SEK 100 000. Even if the policy holder has several disputes they will be regarded as one dispute if the claims are based on essentially the same event or circumstances( a dispute can be regarded as existing even if the motions are not based on the same legal grounds).
I.8 When the policy holder must have been insured to obtain coverage for legal expenses
The policy holder is entitled to legal protection if the insurance is in force when the dispute arises, or if the events or circumstances on which the claim is based took place after the policy came into force. If the policy holder no longer has legal protection cover when the dispute arises because his/her insurance need has ceased, the policy holder may nevertheless have his/her legal expenses paid under this insurance if it was in force when the events or circumstances on which the claim is based took place and not more than ten years have elapsed since then.
I.9 Reclaim
To the extent compensation has been provided under this insurance, Gouda will act for the policy holder in enforcing his/her rights against another party.
J. Personal injury due to assault
Should the injury result in prosecution, the policy holder shall, if we so request, sue for damages in court, wherewith we pay the legal costs according to element I. Legal protection.
J.1 Supplement to the travel insurance in your householders´ comprehensive insurance
If this insurance is taken out as a supplement to the travel insurance in the householders´ comprehensive insurance , compensation during the supplement period is the cost for excess to the householders´ comprehensive insurance, but the maximum amount payable is SEK 10 000 for each individual claim for damages. This also applies if several injuries or cases of damage occur at the same time for the same reason. Before being entitled to reimbursement as stated above, the injury or damage must be settled in accordance with the terms and conditions of the householders´ comprehensive insurance.
J.2 What the insurance does not cover
Compensation will not be paid:
• if the policy holder were under influence of alcohol, sleeping pills, narcotic- or doping substances, if the policy holder cannot prove that there is no connection between said influences and the injury.
Remark: This exception does not apply for rape or other sexual coercion.
• if the policy holder without reasonable ground exposes him-/herself to the risk of being injured.
• for damages in connection with the policy holder being found guilty of a wilful act which according to Swedish law could lead to a fine or greater punishment.
• for damage only based on confession.
• for liability for damages transferred from the person entitled to compensation.
J.3 In the event of injury
Injury that could lead to damages must be reported to Gouda as soon as possible.
The policy holder must also report to the police at the place where the injury occurred and send the police certificate to Gouda. If the policy holder is injured he/she must prove that he/she is entitled to compensation and that the person who caused the injury is unknown or unable to pay the damages.
J.4 Maximum amount
Maximum compensation for each case of injury is SEK 500 000.
K. Property cover (optional)
If the insurance is taken out as a supplement to the travel insurance in the householders´ comprehensive insurance, then terms and conditions according to element K.1 applies. To exclude this property cover, the policy holder must at his/her own initiative chose not to take out property cover when taking out the insurance. If the policy holder has chosen to exclude property cover, claims cannot be made for damage to his/her luggage or property. The insurance policy will tell whether or not the travel insurance excludes property cover.
K.1 Supplement to the travel insurance in the householders´ comprehensive insurance
If this insurance has been taken out as a supplement to the travel insurance in the householders´ comprehensive insurance, the compensation during the supplement period is the cost for the damage or for excess to the householders´ comprehensive insurance, but maximum amount payable is SEK 2 000. All restrictions stated in elements K.2-K.7 are also valid for an insurance taken out as a supplement to the travel insurance in the householders´ comprehensive insurance. Before being entitled to reimbursement as stated above, the injury or damage must be settled in accordance with the terms and conditions of the householders´ comprehensive insurance.
K.1.1 Supplementary reimbursement
Property loss or damage, covered by the terms and conditions in the householders´ comprehensive insurance, exceeding the maximum compensation in the householders´ comprehensive insurance, will be compensated by Gouda regarding the difference between the highest amount payable in the householders´ comprehensive insurance and the actual loss, but with a maximum compensation of SEK 4 000.
K.2 Property covered by the insurance
The insurance covers the policy holders´ private property (luggage) that he/she brings for personal use on the journey.
K.2.1 Maximum compensation
• Personal effects, maximum SEK 6 000 of which:
• cash makes up a maximum of SEK 2 000
• bicycle makes up a maximum of SEK 2 000
• sun glasses makes up a maximum of SEK 1 000
• mobile phones makes up a maximum of SEK 1 000
• snowboard or skiing equipment makes up a maximum of SEK 4 000
• property purchased during the journey makes up a maximum of SEK 3 000
• Tickets, maximum SEK 20 000
• Travel documents, maximum SEK 20 000
• Cost compensation, maximum SEK 2 000
The insurance also covers personal effects that the policy holder has hired or borrowed and that are mainly intended for personal use and for which the policy holder cannot obtain compensation under other insurance policy or agreement.
K.2.2 Property not covered by the insurance
• Motor-powered vehicle (electrically driven vehicle is classified as motor-powered vehicle), caravan or other towed vehicle. The insurance does, however, cover electric wheelchairs.
The insurance also do not apply to parts or equipment for the above mentioned vehicles and crafts.
• Steam boats, motor boats, water scooters, sail boats (except for wind surfboards), hovercrafts or hydro copters, aircraft, hot air balloons, par gliders, gliders, hang gliders or similar craft. The insurance also do not apply to parts or equipment for the above mentioned vehicles and crafts.
• Drawings and manuscripts.
• Stamps, coins and bank notes with a value of collectors.
• Animals.
• Property that according to Swedish law or legislation in the land of residence is illegal to be in possession of or use.
K.2.3 Property especially liable to be stolen are defined as
• cash, travel documents or other types of valuable documents
• items totally or partially made of precious metal, genuine pearls and precious stones/jewels
• antiques and works of art, genuine carpets, pocket and wrist watches, fur coats and furs
• devices/equipment/instruments (as well as parts, accessories and software belonging to such property) intended for production, storage, working, transferring and/or reproduction of sound, text, numbers or pictures
• binoculars, music instruments
• wine and spirits
• computers, computer equipment, diskettes, cd-rom and other parts, accessories and software belonging to such property
• mobile phones as well as parts, accessories and software belonging to such property
• sun glasses
• sports equipment and special equipment such as diving and climbing equipment etc
K.3 General Requirement of care
The insurance covers damage to your property caused by sudden and unforeseen events provided the policy holder has taken due care and attention. The property is required to be kept and stored in such a way as to prevent theft as far as possible. The nature of the property has great importance on the requirements for keeping and storing, for example if the property is of particular value and/or for goods especially liable to be stolen or for property of such a nature that it would appear natural in the circumstances to pay it extra care and attention. Compensation will be reduced or denied if these requirements are not fulfilled. The general deduction is 50% if the requirements of care are not fulfilled. The deduction can, however, be larger or smaller, depending in how serious the lack of care is. In addition to the requirements listed above there are specific requirements of care under each element below.
K.4 Events covered by the insurance
K.4.1 Burglary in the place of residence
The insurance applies to theft or damage within the place of residence. Place of residence does not include cellars or attics of apartment buildings, freestanding garages, outhouses or similar. In addition, place of residence does not include caravans, tents or equivalent.
K.4.1.1 Limitations
The insurance does not apply if the theft or damage is perpetrated by persons who have been given permission to be in the place of residence. This also applies if a person has gained entry by the use of a key he/she has been given permission to use.
K.4.1.2 Due care and attention
Windows, doors etc. must always be locked and bolted from the inside when you leave your home. A key must not be left at, or hidden nearby, the place of residence, nor marked or stored in such way that unauthorised persons can determine its use.
If the policy holder shares the place of residence with others, the door to the own room shall be locked with a key that only the policy holder have access to, if the policy holder leaves the room.
K.4.2 Theft or loss of property brought by the policy holder
The insurance applies to theft or loss of property, brought by the policy holder, outside the place of residence. Lost labelled, checked- in, luggage that, according to certificate from the transport company, has not been found within 30 days is regarded as stolen.
K.4.2.1 Limitations
The insurance does not apply to loss in connection with so called comprehensive damages.
K.4.2.2 Due care and attention
Brought property is required to be kept and stored in such a way as to prevent theft as far as possible.
The requirements for due care and attention are higher depending on the value and nature of the property. Goods especially liable to be stolen shall be kept under constant supervision by the policy holder. If the policy holder leaves goods especially liable to be stolen in a hotel room or similar, the room must be locked and the property be kept in locked space, like a box or a locker.
K.4.3 Theft of or damage to bicycle
The insurance applies to theft or damage to bicycle which is kept correctly locked. Correctly locked is described under due care and attention requirements below.
K.4.3.1 Due care and attention
When leaving the bicycle it must be locked with a permanently mounted bicycle lock, padlock and chain or with a shackle or similar.
K.4.4 Damage to or loss of property other than as a result of theft
Fire and explosion
The insurance applies to damage to property as a result of spread of fire.
The same applies if the damage is incurred as a result of explosion, sudden blackening with soot or by corrosive gas formed through the unintentional heating of plastic.
Leakage
The insurance applies to damage to personal property by liquid or steam that has leaked in an unforeseen way, if the leakage has occurred from a tank or pipe system for water or oil installed in the building, or from aquariums and waterbeds. The insurance also applies to damage caused by leaks from smoke duct, ventilation duct, drainage systems, down-pipe, roof or gutter.
Natural perils
The insurance applies to damage on property kept in a building which is damaged from water or freezing or any unavoidable consequence of damage to the building during:
• storm with a wind speed of at least 21 m/s
• hail
• lightening
• torrential rain; rain with an intensity of at least 1 mm a minute or 50 mm in 24 hours,
• Earthquake (at least 4 according to the Richter scale), landslide, landslip, rockslide, avalanche or volcanic eruption.
• breakthrough of a water dam
• snow pressure; damage caused by the collapse of the outer roof on a building of a residence (not including roof of terrace, veranda or balcony or similar roof) under the pressure of snow.
Crashing aircraft
The insurance applies to damage caused by aeroplanes or other aircraft crashing or as a result of parts falling from such craft.
Damage caused by wild animals
The insurance applies to damage to personal property caused by wild animals entering the place of residence. The insurance applies to damage caused by rats, mice and other rodents or insects that caused sudden and unforeseen damage to property.
Damage caused by robbery or stealing of handbags
The insurance applies to property stolen or damaged during robbery or stealing of handbags. The insurance also applies to property damaged during an assault.
Damaged property during an accident
The insurance applies for property damaged or lost during an accident where the policy holder is injured or involved.
K.4.5 Compensation regarding costs in connection with damage covered by the insurance
The insurance includes compensation up to a maximum of SEK 2000 regarding necessary and reasonable additional costs directly related to a damage covered by the insurance. Compensation for transport to police station when reporting a damage, costs for telephone calls when blocking a stolen mobile phone/credit card, costs for interpreter, translation, transport to get a new credit card or similar. All costs must be proven by original receipts.
K.5 Events not covered by the insurance
• Loss in connection with so called comprehensive damages.
• Damage caused by wear and tear, consumption, self-destruction or ageing.
• Damage to the surface of suitcases and similar such as dents, scratches etc. without significant impact on the items´ functionality.
• Damage resulting from inadequate or unsuitable packaging.
• Damage resulting from staining, soiling, battering or tearing.
Note: Such damages are however covered in connection with events listed in element K.4.4.
• Damage/theft on checked-in property or during registration or other type of consignment or forwarding when you haven’t been a passenger on the means of transport.
• Damage due to the effects of weather.
• Damage as a result of leakage of a liquid or sticky substance.
• Damage to sports equipment during use.
• Loss as a consequence of using bank- or credit card, cheque, bill of exchange and similar.
• Loss of property (including cash and valuable documents) forgotten, left behind, lost or mislaid, even if it was stolen later on. If the property has been lost and the policy holder is unable to show how the loss likely occurred, it will be deemed forgotten, lost or mislaid.
• Loss of your own work, income, travel expenses, board and lodgings or other costs regarding yourself or other policy holder.
• Damage that can be compensated by another insurance, transport company, hotel or similar.
• Theft from hotel room, passenger cabin or similar that was left unlocked.
• Theft from car, caravan or similar that was left unlocked.
• Theft/loss of property especially liable to be stolen if:
- kept in a boat, tent, car, camper, caravan or similar.
- kept in or on top of a motor vehicle
- checked in as baggage
K.6 How items are valued and reimbursed
K.6.1 Rules for compensation
Gouda reserves the right to compensate the policy holder with a new or second-hand item instead of cash, or if the object is broken, to have it repaired. Gouda also reserves the right to decide where replace or repair is to be carried out.
If an item for which Gouda has compensated the policy holder comes back into the policy holders´ possession, the policy holder must immediately hand it in to Gouda. The policy holder can keep the recovered object, provided the policy holder returns the compensation received from Gouda. Deduction will be made if compensation is paid from elsewhere such as transport company or hotel.
K.6.2 How compensation is calculated
The object is valued and compensated after taken into consideration age, wear and tear, modernity, functionality and other factors, but excluding sentimental value.
K.6.2.1 According to market value
Property is valued according to market value, meaning the cost for replacing equivalent property of same type and in same condition as the property at the time for theft/loss or damage. It can imply an essential depreciation regarding computers, sound recording, computer equipment and mobile phones.
K.6.2.2 According to fixed depreciation
If calculating according to market value is not possible compensation is calculated by the use of fixed depreciation based on the price of the object at the time of purchase:
– 0-2 years: No depreciation due to age
– up to 3 years: -20% depreciation due to age
– up to 4 years: -40% depreciation due to age
– up to 5 years: -60% depreciation due to age
– older than 5 years: -80% depreciation due to age
Deduction is never more than 80% if the property was in working order at time for damage.
Example: You have been robbed of a two years and two months old camera that cost SEK 4 000 at the time of purchase. After a depreciation due to age of -20% the compensation is 80% of the price at the time of purchase, e.g. SEK 3 200.
K.6.2.3 Disposable goods
Disposable goods like cosmetics, perfume, after shave, toiletries, sanitary articles etc. are compensated with a maximum of 50% of the cost for new equivalent items.
K.6.2.4 Limitations
Computer media, photographs, film and tape recordings as well as home made items, for example hand sewn clothes, home made food and models with no market value are compensated with the cost of the raw materials.
K.7 Policy holders´ responsibility
All thefts/loss´/damages of property shall be reported to Gouda in writing. The following documents shall be sent to Gouda:
- written claim form.
- police certificate, or certificate from other authority involved if other damage than theft.
- original receipts or similar regarding lost property.
- specified claim for compensation
Theft, robbery or assault must immediately, or as soon as possible, be reported to the police where the damage occurred.
Damage that occurs during transport or at a hotel must also be reported to the transporting company or hotel. The policy holder is obliged to provide Gouda with information and documents that Gouda requests to settle the claim.
When losing insured property, the policy holder must be able to prove ownership of the lost property as well as its´ value and age. The requirements for proving ownership, value and age are higher regarding money, tickets, travelling documents, property especially liable to be stolen or other property of high value. When losing property that is bought second- hand, original receipt or corresponding that shows age and value shall be sent to Gouda. If the policy holder fails to prove ownership, value and age in a satisfactory way, compensation can be reduced or denied. The policy holder is obliged to inform Gouda if he/she has other insurance that covers the same damages or injury as reported to Gouda. In such a case, the policy holder is not entitled to more compensation, all together with compensation from other insurance, than covers the damage or injury. Repairs must only be carried out on Goudas´ approval. Damaged items must be kept until Gouda has had the opportunity to inspect them. The policy holder is obliged to cooperate and take part in inspection of damaged property as well as undamaged property.
L. Holiday guarantee
Holiday guarantee can only be taken out for journeys no longer than 45 days. If insurance is taken out for a journey longer than 45 days this element is automatically excluded from your insurance policy. If you take out insurance for a journey no longer than 45 days you will have to exclude this element when signing up for the insurance in order to exclude this element and it will then show on your insurance policy.
L.1 Missed departure
The policy holder is entitled to compensation if a sudden and unforeseen event occurs after his/her journey has begun which causes him/her to miss the departure from the Nordic region or a direct connection within Europe, or if the policy holder misses the departure of the return home from the final destination. The policy holder will be compensated for necessary and reasonable costs in order to catch up his/her journey. Compensation will only be approved if the event causing the missed departure couldn’t have been foreseen or prevented by the policy holder. If the policy holder misses the departure from the Nordic region and a connection is not possible, or if the policy holder, due to the missed departure, looses more than half of the days of the planned trip, Gouda will compensate the entire journey corresponding to the price of the missed journey.
L.1.1 Maximum compensation
The highest amount payable is SEK 25 000 per traveller.
L.1.2 Policy holders´ responsibility
The policy holder must ensure he/she is at the place of departure at least two hours prior to departure when travelling within the Nordic region and at least three hours prior to departure when travelling within Europe and the rest of the world, if not a separate contract has been signed between the travel organizer and Gouda.
The policy holder must also consider the weather and traffic situation when starting the journey. If the journey contains a direct connection within Europe the policy holder must have at least a three- hour margin for changing means of transport. The policy holder must always contact Gouda or the travel organizer before booking new tickets. The policy holder must also be able to confirm expenses with original receipts.
L.1.3 Exceptions
The insurance does not cover expenses that could be reimbursed from elsewhere in accordance with laws, other statutes, conventions, insurance policies or damages. The insurance also do not cover events connected to bankruptcy or official actions.
L.2 Delay
L.2.1 Delay of public transport
The insurance will give out compensation if the public transport the policy holder is travelling with or shall travel with is delayed more than 4 hours. Compensation will be paid as follows:
- Delay more than 4 hours: SEK 400 for necessary and reasonable additional costs due to the delay.
- Delay more than 12 hours: SEK 400 (standard compensation)
- Delay more than 24 hours: SEK 400 (standard compensation)
L.2.1.1 Policy holders´ responsibility
The policy holder must prove the delay in writing from travel organizer, airlines or other transporters. If the delay was between 4 and 12 hours the policy holder must prove his/her expenses with original receipts. The purchases must have been made at the place where the delay occurred and during the delay. When the delay is more than 12 hours you are entitled to standard compensation without sending in prove for any purchase.
L.2.1.2 Limitations
The delay must be unforeseen and unplanned. Alterations to timetables made public before the departure from the policy holders´ place of residence or equivalent is not regarded as a delay in accordance with these terms and conditions. If the delay is caused by strikes, trade union actions or a lockout, the policy must have been paid before the dispute broke out, or was given notice of.
L.2.1.3 Exceptions
The insurance does not compensate purchase of spirits. The insurance also do not cover events connected to bankruptcy or official actions. The insurance does not cover expenses that could be reimbursed from elsewhere in accordance with laws, other statutes, conventions, insurance policies or damages.
L.2.2 Luggage delay
The insurance will give compensation if the policy holders´ luggage is delayed more than 6 hours after arrival when travelling from Sweden, or at an outward journey to a stage point on the trip. Compensation will not be paid if the luggage is delayed at your journey home.
Compensation is paid as follows:
- Luggage delay more than 6 hours: SEK 400 for necessary and reasonable costs for purchase of clothes, hygiene items or similar.
- Luggage delay more than 12 hours: SEK 600 (standard compensation)
- Luggage delay more than 24 hours: SEK 600 (standard compensation)
L.2.2.1 Policy holders´ responsibility
Luggage delays must be confirmed by a PIR-report from the carrier to be valid for compensation. If the delay was between 6 and 12 hours the policy holder must prove his/her expenses with original receipts. When the delay is more than 12 hours you are entitled to standard compensation without sending in prove for any purchase.
L.2.2.2 Limitations
If the delay is caused by strikes, trade union actions or a lockout, the policy must have been paid before the dispute broke out, or was given notice of. If the policy holder has been compensated for luggage delay, and thereafter becomes entitled to compensation for damaged or lost property, deduction will be maid, with the amount received for luggage delay, from the compensation due to damaged or lost property. Deduction will also be made for expenses reimbursed from elsewhere in accordance with laws, other statutes, conventions, insurance policies or damages.
L.3 Compensation for missed connection when returning home
If the public transportation used is delayed when returning to the place within the Nordic region where the journey started and the policy holder therefore is not able to make it in time to catch a planned connection with other means of public transport, the insurance can compensate for necessary and reasonable additional costs for travelling, board and lodging. Maximum compensation is SEK 2 000.
L.3.1 Limitations
In order to be entitled to compensation, the policy holder must follow instructions from the public transport company or the travel organizer. The connection to the policy holders´ place of domicile must be planned so that check- in is ensured at least two hours prior to planned departure time or longer if the transport company or travel organizer so requires.
L.3.2 Exceptions
The insurance does not cover expenses that could be reimbursed from elsewhere in accordance with laws, other statutes, conventions, insurance policies or damages. The insurance also do not cover events connected to bankruptcy or official actions.
L.4 Ruined holiday
Maximum compensation per traveller is SEK 20 000.
L.4.1 Delayed arrival
The insurance will give compensation if the public transport you are travelling with is delayed and you therefore arrive at the final destination more than 24 hours later than planned. The delay must be unforeseen and unplanned. Timetable alternations made public before departure from your place of residence is not regarded as a delay in accordance with these terms and conditions. Compensation will be paid with a daily price for each ruined day.
L.4.1.1 Policy holders´ responsibility
The policy holder must prove the delay in writing from the transport company or other authority involved. If the delay is caused by strikes, trade union actions or a lockout, the policy must have been paid before the dispute broke out, or was given notice of. The policy holder must be at the place of departure at least two hours before departure from the Nordic region and three hours within Europe and the rest of the world, if a separate agreement hasn’t been made between the travel organizer and Gouda.
L.4.1.2 Limitations and exceptions
The journey must be booked and paid for before departure. The insurance does not cover expenses that could be reimbursed from elsewhere in accordance with laws, other statutes, conventions, insurance policies or damages. The insurance also do not cover events connected to bankruptcy or official actions.
L.4.2 Policy holders´ illness or accident
The insurance will give compensation for ruined days if the policy holder becomes ill or is injured during the journey and for medical reasons, partly or totally, looses the main purpose of the journey. The insurance will compensate you for each ruined day with a daily price for the amount of days you were ill in accordance to the medical certificates written by the treating physician.
The insurance also will compensate you for ruined days if you, due to illness or accident, miss out on a planned stage of the journey. Compensation is given for the total number of days for the planned stage of journey, even if the illness or accident didn’t last throughout the whole period for the missed stage of journey, if the illness or accident made it impossible for you to begin the stage of journey. Compensation is given provided that it was impossible for you to resume the stage of journey at any point of the stage in question. If you are able to resume the stage of journey at any point compensation is given only for the number of days actually lost.
The insurance also compensates, in accordance with terms and conditions above, one (1) fellow traveller if you are hospitalized due to illness or accident or if a doctor prescribed that you needed care and supervision by a family member or fellow traveller.
L.4.2.1 Limitations and exceptions
The day for the first doctors´ visit is regarded as the first day of illness according to these terms and conditions. Compensation will not be paid if illness or accident can´ t be proven with medical certificate written by the treating physician.
L.4.2.2 Policy holders´ responsibility
In order to be entitled to compensation, the policy holder must be able to prove illness, number of days of illness, doctors´ advice not to begin a planned stage of journey, doctors´ prescription regarding need for care and supervision from a family member or fellow traveller, by a medical certificate written by the treating physician at the place of stay. If the medical certificate does not include details of loss of activities or the number of days of illness, compensation will be determined by the use of standard amounts drawn up in consultation with medical expertise.
Examples of standard amounts:
• Cold - three daily allowances
• Stomach problems – two daily allowances
• Tonsillitis – five daily allowances
• Flu – five daily allowances
• Sunburn – two daily allowances
• Allergies – two daily allowances
• Sinusitis – four daily allowances
• Ear problems – three daily allowances
• Pneumonia – seven daily allowances
• Fever – three daily allowances
• Urinary tract infection – three daily allowances
• Lumbago/sciatica – three daily allowances
• Chicken pox – seven daily allowances
Should you be affected by more than one illness, compensation with be paid in accordance with the illness that entitles you to the highest daily allowance.
L.4.3 Other serious event
Should another serious event occur that results in the policy holder not being able to use the trip as planned for at least 12 hours, the insurance will give compensation for each ruined day. Events that entitles to compensation are:
• the policy holder has to return to Sweden earlier than planned due to a fellow travellers´ illness, accident or sudden and unexpected death. The insurance entitles to compensation for the numbers of days actually lost.
• a close relative in Sweden becomes seriously ill, has a serious accident or dies. Compensation will be paid for two lost days. If the journey is interrupted the insurance will compensate by the actual number of days lost.
• serious damage to the policy holders´ private property in Sweden through a sudden and unforeseen event. Compensation will be given for one ruined day. If the journey is interrupted the insurance will compensate by the actual number of days lost.
• the policy holder becomes a victim of a burglary/robbery/assault/damage due to fire or water/traffic accident casing injury or a natural catastrophe at the destination. Compensation will be given for one ruined day. If the journey is interrupted the insurance will compensate by the actual number of days lost. If the policy holder must report the incident to the police at the destination the insurance will compensate by a half ruined day, for one person per damage, even if the issue takes less than 12 hours.
L.4.3.1 Policy holders´ responsibility
If a serious event occurs that might lead to compensation, the policy holder must report the event to Gouda without delay. The policy holder must be able to prove the event by police report, medical certificate or a certificate from an authorized body or other that Gouda approves. Medical certificates must be issued by the treating doctor who must be certified and impartial.
L.4.4 Exceptions regarding element L.4
You are not entitled to compensation for ruined holiday, daily price:
• due to pre-existing medical conditions, illness or accident that showed symptoms later than 6 months prior to the insurance period started
• due to sexually transmitted diseases
• due to medical conditions, illnesses or accidents caused by the use of doping substances, sleeping pills, alcohol, narcotics or similar substances.
• due to medical conditions, illness or accident caused by serious mental disorder
• due to events in connection with pregnancy
The insurance does not cover expenses that could be reimbursed from elsewhere in accordance with laws, other statutes, conventions, insurance policies or damages. The limitations and exceptions listed in element E does also apply for element L.4.
L.5 Hire of sporting equipment
You are entitled to compensation with a maximum amount of SEK 3 000, during the journey, for hiring sporting equipment if your own equipment is delayed, stolen or damaged during transport or use.
L.5.1 Policy holders´ responsibility
Delay or damage during transport must be proven by certificate in writing from the transport company. If the sport equipment is stolen the policy holder must send in a police report made without delay when theft is detected. You have to prove the costs for hiring equipment by sending in original receipt.
L.5.2 Limitaitons
If the equipment is delayed, the insurance only compensates costs for hire of equivalent equipment until the original equipment is recovered. Delay must be longer than 4 hours and be verified with a PIR report in order to entitle to compensation.
L.6 Reimbursement of activity costs
If the policy holder is entitled to compensation for ruined days according to element L.4.2 then he/she can also be compensated for costs regarding planned and prepaid activity that the policy holder can’t participate in due to illness or accident.
As a activity cost is regarded prepaid costs for example diving course, green-fee, lift ticket, a guided tour, entry tickets and similar. Costs for accommodations, transfer and travelling with public transport (fo example aeroplane, buss, train).
Compensation is given with a maximum amount SEK 10 000 per event and activity.
L.6.1 Exceptions
The limitations and exceptions listed in element E also applies to element
L.6.
M. Crisis therapy
Maximum compensation for costs regarding crisis therapy is SEK 10 000 per injury and policy holder. Crisis therapy must be carried out by a registered psychologist or psychotherapist within 12 months from the time of the incident. To be entitled to compensation, the policy holder must contact Gouda or Gouda’s Emergency centre before commencing treatment.
N. General terms and conditions
The term of validity is the period for which the policy holder has taken out the insurance. The policy period starts when the journey commences, but at the earliest 00.00 the first day of cover specified in the insurance policy, or the time specified by the circumstances. To be valid, the insurance premium must be fully paid before the term of validity begins. If the insurance is taken out the same day the journey begins, the insurance is not valid until full payment has reached Gouda. The insurance is only liable to events that occur during the term of validity.
N.2 Mentally abnormal persons and children
If due care and attention or other directive is set aside and neglected by somebody in a mental state as stated in chapter 30, section 6 of the Criminal code, or by somebody under the age of 12 years, the coverage will not be reduced or denied on. However, if someone in a normal state of mind and over the age of 12 years has approved or had part in the activity, compensation may be reduced or denied for this person.
N.3 The personal data act (1998:204), (PUL)
The personal details we receive about you in connection with taking out this insurance policy and in connection with our claims adjustments are necessary for us to be able to manage the insurance and fulfil our contractual obligations and meet the needs of you as a customer. The details can also be used to evaluate and decide on shape and content of our insurance policies and market analyses.
Personal details can, for this purpose, be given to companies we cooperate with. Personal details can also be used to send you information about other services we provide along with our partners.
We also have a certain amount of responsibility towards authorities with regard the duty of disclosure. This means that we must provide authorities with the information they demand. You are also entitled to demand written information from us about yourself and how it is used. You can also make a written request to us if you do not want your personal details used for marketing purposes.

N.4 Actions by the policy holder
N.4.1 Limiting damage or injury
The policy holder shall, to the best of his/her ability, attempt to limit the damage or injury that has already occurred and avoid damage or injury that could immediately occur. If the policy holder, intentionally or through gross negligence, neglect to limit damage or injury and this results in damage for Gouda, compensation will be reduced or denied.
N.4.2 Fraudulent information
If you give fraudulent information, conceal from or withhold anything of significance for the handle of the claim compensation will fall off.
N.4.3 Provocation of the insurance case
If you by intent have provoked the insurance case, or worsen the consequences of an insurance case, no compensation will be paid out. Negligent behaviour can come to a lowering of the insurance compensation. The behaviour of the insured is placed on equality with behaviour of a family member, or other person who acts with the approval of the insured. 26
N.4.4 Neglect of security regulation
If you neglect a security regulation, given in the terms of the insurance or by constitution, the compensation will get reduced due to what is reasonable with the circumstances and other conditions in mind.
N.5 Vaccinations and medicines
It is the responsibility of the policy holder to ensure he/she has the vaccinations required before departure to the destination. Should the policy holder suffer from a condition that requires special medicines, it is the responsibility of the policy holder to ensure he/she brings along enough medicine to last the whole journey. If the policy holder should neglect to do so, compensation will be reduced or denied for costs that arise due to this negligence.
N.6 Payment of compensation
Compensation is to be paid within a month from when the policy holder has completed all his/her obligations. If the total claim cannot be settled at once, but it is obvious that the policy holder is entitled to a certain amount, Gouda will pay this certain amount while waiting for the entire claim to be processed. Regarding property that has been repaired or recovered, compensation will be paid within a month after repair or recovery.
N.7 Interest
If, for some reason, payment of compensation is delayed with regards to what is stated in element O.7, the policy holder is entitled to interest for the period of delay in accordance with the Swedish law on interest. If the delay is due to a police investigation the policy holder is only entitled to the official discount rate of the Swedish Central Bank.
N.8 War damage
The insurance does not cover injury or damage by war, warlike events, civil war, revolution or uprising in Sweden. The insurance will, however, be valid for injury or damage due to war or other above mentioned disturbances occurring outside of Sweden, with the exception of element J. Personal injury due to assault, provided the injury occurs within three months of the disturbance breaking out and that the policy holder was in the area affected when the disturbance broke out.
Another condition is that the policy holder must not be taking part in the events or by those reporting the events etc. Gouda will pay for necessary additional costs under the same conditions, but not for participants of group tours as specified in the Swedish Travel Guarantee Act. We also pay for loss of luggage due to property being confiscated, or policy holder had to leave it behind during evacuation. The insurance does not cover injury or damage suffered if the policy holder travels to countries where war, war-like activities, civil war, revolution or uprising has broken out. Gouda follows the recommendations of the Swedish Foreign Ministry regarding which countries to avoid travelling to, leave or not stay in.
N.9 Additional cost for delay during injury or damage sustained in war
For unavoidable extension of your stay abroad for more than 24 hours, the insurance compensates for additional costs for board and lodging as a result of the delay with a maximum of SEK 200 for each begun 24-hour period, but not for longer than 30 days and not if the policy has been in force longer than three months at the time of the disturbance breaking out.
N.10 Atomic damage
The insurance does not cover damage to property or liability for damages if the damage is directly or indirectly caused by an atomic nuclear process.
N.11 Force majeure
The insurance does not cover loss that could occur if the inquiry, repair or payment of compensation is delayed due to war, warlike events, civil war, revolution or uprising or due to actions of authorities, strikes, lockouts, blockades or similar.
N.12 Double coverage
If the same interests are covered against the same risk by several companies then each company is liable towards the policy holder as if they had granted cover by themselves. You are not, however, entitled to a higher compensation from the companies than the joint amount that corresponds to the claim. If the liability amount exceeds the claim, liability is divided between the companies in relation to the amounts of liability.27
N.13 Disputes
If Gouda and the policy holder cannot agree on the value of the damage to personal property or another procedure, an arbitrator authorized by the Swedish Chamber of Commerce will be requested to intervene. The arbitrator will apply the evaluation rules of these terms and conditions. The cost to the policy holder of such an evaluation is SEK 500 plus 10 % of any excess amount, up to a maximum of half the payment to the arbitrator. Should the arbitrator decide on a higher amount than Gouda has offered, Gouda will pay for the entire evaluation process.
N.14 Recovery
To the same extent that Gouda has paid compensation for damages, Gouda reserves the right to demand compensation from those responsible for the damage. If it is a private person, Gouda will only demand compensation if he/she caused wilful damage of damage through gross neglect or if the damage is related to his/her gainful employment.
N.15 Legal provisions
This insurance policy is subject to the provisions of the Swedish Insurance Contracts Act (2005:104), (FAL), and Swedish law in general. Disputes arising from the insurance agreement or from these Terms and Conditions will be settled under Swedish law at a Swedish Court, unless otherwise agreed or specified in the insurance policy.
N.16 Prescription of claim
Injury or damage must be reported as soon as possible, but at the latest within three years from when the policy holder realised he/she could claim for compensation. Assessments of prescriptions are in accordance with chapter 7, §4, of the Swedish Insurance Contracts Act 2005:104 (FAL). The policy holder forfeits his/her right to insurance compensation if a claim is not raised within three years from the date he/she realised a claim could be raised, and in any case within ten years from when the claim could be made. If the policy holder has notified Gouda within the timescale indicated here, the policy holder always have six months to take legal proceedings against Gouda, from the day on which Gouda has advised the policy holder of our final decision in the matter of compensation.
N.17 Refund of premium
The policy holder will be refunded the premium paid without any administrative fees in the following cases:
• If the premium has been paid twice (only one of two premiums paid will be repaid).
• If you choose not to begin your journey.
The policy holder will be partly refunded the premium paid, but after an administrative fee of SEK 100 in the following cases:
• If you choose to interrupt your started journey and return back early to Sweden.
Refunds can be made for the part of the premium which corresponds with the part of the insurance period which was left when returning to Sweden.
If you would like to apply for a premium refund, you should complete an application form and send to Gouda. You can find the application form on our website www.gouda-rf.se. You can also call us on +46 8 615 28 00 and we will send the application form to you. If your application depends on an interrupt journey, you will have to certify the time of your return with a boarding card, luggage tag or similar containing your name and date of return.
N.18 Claims handling
The details provided for handling claims will be registered and managed using information technology.
N.19 Supplement to the travel insurance in your householders’ comprehensive insurance
Before being compensated according to these Terms and Conditions for an insurance taken out as a supplement to the travel insurance in the householders’ comprehensive insurance, during the supplement period, and/or in other cases where Gouda compensate to cost for excess for another insurance, the damage must be settled in accordance with the Terms and Conditions of that insurance.
N.20 Compensation from other insurance
If the policy holder is entitled to compensation from elsewhere due to law, statute or another policy compensation will not be paid from this insurance.
N.21 Reconsideration and appeal
If you have received a decision from Gouda in which you have questions about or which you think is incorrect in relation to the injury or the damage, or to the policy conditions, Gouda wish you to urgently contact us. We want to make sure that there was no misunderstanding or that the decision is made on incorrect or incomplete bases.
Gouda asks you to first collect your comments and send a written request for reconsideration to Gouda. A new claims handler will then review your case and get back to you with answers on your questions and comments.
If you still should have comments on Gouda’s decision after our internal reconsideration, we refer you to someone of the following instances for further advice and appeal:
Konsumenternas Försäkringsbyrå: The bureau is driven jointly by the insurance companies, the Swedish financial supervisor authority (Finansinspektionen) and the Swedish consumer agency (Konsumentverket), and is responsible for providing free advice for private persons and some traders in insurance issues.

• The Swedish national board for consumer complaints (ARN): ARN has a special department for insurance issues for private persons. If the policy holder would like ARN to look into his/her case, he/she should contact ARN:s office. The service is free of charge. The board does not deal with negligence issues, injuries related to traffic accidents or medical disability assessments.

• Court: As in all disputes, the policy holder can have his/her case examined by a court. The policy holder can contact his/her nearest district court for more information.
Legal protection cover is valid, within the framework of the Terms and Conditions, even in disputes with Gouda. Please note that if the dispute concerns valuation it must be examined in accordance with element N.13 in the General Terms and Conditions.
O. Definitions
Acute illness: Acute illness means an illness condition which occurs during the insurance period. The illness is considered to have arisen during the insurance period if the symptoms appeared and the first visit to a doctor was made after the insurance period began.
Acute injury: Acute injury means an injury which occurs during the insurance period and which is not defined as an accident. The injury is considered to have arisen during the insurance period the injury occasion occurred, symptoms appeared and the first visit to a doctor was made after the insurance period began.
Acute dental problems: Acute dental problems means problems which occur sudden and unpredictable and are not due to deficient oral hygiene or not having regular dental treatment every 18 months.
Comprehensive damage: Comprehensive damage means damage on property that arises through sudden and unpredictable event. Example: If you stumble and drop and damage your camera, this is concerned as a comprehensive damage.
Daily allowance: Daily allowance is the form of compensation which applies in element L. Holiday guarantee. Compensation is paid as a whole or half daily allowance for each ruined travel day. A daily allowance is the travel cost, i.e. cost for accommodation, transfer and travel with public transportation (for example flight, bus, train), divided by the number of travel days. Planned/estimated and not yet paid costs are not considered as travel costs. Cost, which per definition is considered as an activity cost, is also not considered as a travel cost.

Homeland: Homeland is country of domicile in Scandinavia, i.e. the country where the policy holder is registered and living in prior the journey.
Burglary: Burglary means someone unlawfully and with violence breaking into or pick-locking his/her way in to the residence.
Supplement to the travel insurance in the householders’ comprehensive insurance: Concerns the period when both the travel insurance in the householder’s comprehensive insurance and Gouda’s travel insurance is valid. During this period the householders’ comprehensive insurance bears the primary responsibility for occurred damages and Gouda can only give secondary compensation according to the rules of the supplementary period which is found under concerned elements in this policy condition.
Doctor: Doctor is, unless otherwise is specified in these policy conditions, the treating doctor on the destination. The doctor must be certified, competent and unbiased.
Travelling companion: Travelling companion is a person who, together with the policy holder, has ordered the journey and taken out the same insurance as the policy holder.
Close relative: Close relative means wife, husband, partner, registered partner, child, stepchild, siblings, stepsiblings, parents, stepparents, grandparents and parents-in-law, grandchildren, son-in-law, daughter-in-law or other person with whom the policy holder is living. Child also includes foster child whom is registered at the foster family.
Necessary and reasonable costs: Necessary and reasonable costs means costs which Gouda, due to the circumstances in the individual case, reasonably could have expected as customary and usual, both according to the size and the nature of the cost.
Accident: Accident means involuntary physical injury caused by a sudden and unforeseen external force (external violence). For frostbites, heatstroke and sunstroke the requirement for “sudden” is disregarded. The day the injury first appears will be considered as the time of the accident.
PIR-report: Property Irregularity Report, is the report the responsible transportation company is writing in connection with delay or loss of checked-in luggage.
Checked-in luggage: Checked-in luggage means luggage which is handed over to a transportation company, Airline or other for forwarding (checked-in luggage) even if the policy holder is on the same transportation.
Travel day: A travel day is every 24 hour period.
The travel guarantee act: Persons covered by the travel guarantee act are the persons who purchase a journey marketed advance through programmes that specify the cost of the trip and accommodation. The travel guarantee act also covers those who purchase a trip designed for a group of travellers.
Travel documents: Travel documents are defined as travellers’ cheques, passports, petrol and restaurant coupons, ski lift pass, green-fee card or equivalent.
Robbery: Robbery presupposes acts of violence against a person or the use of threats that represent immediate danger. This also includes milder forms of force against a person provided that the act is immediately perceived as such by the person in question and said person does what could reasonably be required to prevent or reduce the amount of injury or damage and that the event can be verified by a reliable investigation.
Partner: Partner means the person you live with under marriage conditions and who is registered at the same address as you. A requirement for being defined as partners is that none of the parts is married or have a registered partnership with any one but the person they live with.
Claim form: Gouda’s form for report a claim, which is found on our website www.gouda-rf.se. The form can also be obtained per phone +46 8 615 28 00.
Property especially liable to be stolen: Property especially liable to be stolen are defined as cash, travel documents or other types of valuable documents, items totally or partially of precious metal, genuine pearls and precious stones/jewels, antiques and works of art, genuine carpets, pocket and wristwatches, fur coats and furs, devices, equipment and instruments, as well as parts, accessories and software belonging to such property, intended for production, storage, working, transferring and/or reproduction of sound, text, numbers or pictures, binoculars, musical instruments, wine and spirits, computers, computer equipment, diskettes, cd-rom and other parts, accessories and software belonging to such property, mobile telephones as well as parts, accessories and software belonging to such property, sun-glasses, sport equipment, special equipment such as diving and climbing equipments etc.
Dispute: Dispute means a legal disagreement which can not be solved without involvement by legal instances. A dispute is considered if all non-legal opportunities are tested.
Valuable documents: Valuable documents means shares, bonds, bankbooks, debentures, stamps, coupons, tickets etc.
Assault: Assault is defines as damage or personal injury caused by unprovoked violent force without consent.
P. Measures when injury occurs
P.1 When injury or damage occurs
If you suffer from a damage which you are entitled compensation for, you should follow the following instructions and the instructions which are found in each element of compensation in the policy conditions.
Claim form should always be completed and sent to us. A claim form can be printed from our website www.gouda-rf.se, or you can call Gouda on +46 8 615 28 00 and we will send the claim form to you. Injury or damage must be reported as soon as possible and at the latest within three years from when the policy holder realised he/she could claim for compensation. Assessments of prescriptions are in accordance with chapter 7, §4, of the Swedish Insurance Contracts Act 2005:104 (FAL).
The policy holder must specify his/her claim for compensation and give us the information and documents, for example purchase receipts, doctors’ certificate etc., we need to settle the claim.
P.2 Policy holders´ responsibility
Below is a guide to how the policy holder should act in case of damage or injury, depending on what type of damage or injury that has occurred. The guide is general and should be read together with the rules which are to be found under each element of compensation in the policy conditions.
Medical care
Contact Gouda Assistance, if possible before the medical care. Then we have the opportunity to give coverage information in advance and arrange a guarantee of payment to the providers which accept the guarantee. If you have seen a doctor without contacting us you can ask the provider to bill us or pay for the visit and thereafter send the original receipt and other medical documents together with a claims form to Gouda for claim handling
Hospitalization
Gouda Assistance should immediately be contacted if acute illness, acute injury or accident requires hospitalization.
Death
In case of death, contact Gouda Assistance which can arrange necessary arrangements together with authorities involved.
Repatriation
Gouda Assistance should be contacted for assessment and arrangement in case of repatriation. If the policy holder or a close relative to the policy holder arranges the repatriation, the policy holder must complete a claims form and send to Gouda for assessment together with original receipts for the costs. If the policy holder must be repatriated home due to medical reasons, Gouda Assistance must me contacted for assessment together with the policy holders treating doctor.
Crisis therapy
Contact Gouda or Gouda Assistance. All treatment must be approved by Gouda in advance. The occurrence must be verified with a certificate from authorisation involved and costs must be verified with original receipt.
Compensation for disability and death
Contact Gouda for further instructions.
Delay
A Claim form should be sent to Gouda together with a certificate from transporter/organizer together with a original receipt for the expenses the delay has caused.
Luggage delay
A claim form should be sent to Gouda together with a PIR-report from the responsible transporter and original receipt for the expenses the delay has caused.
Theft/other property damages
Theft, robbery and burglary must be reported to the local police on the place of stay in direct connection with the occurrence. Damage/theft during transportation should be reported to the transporter and you must show a certificate from the transporter regarding their eventually paid compensation. A claim form should be sent to Gouda as soon as possible together with a police report/certificate from the transporter and original receipts which verify the lost property.
Ruined holiday
